By downloading, installing, or using the Nova AI mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Nova AI is a mobile application that provides an AI assistant powered by small language models (SLMs) that run entirely on your device. The App allows you to:

• Interact with AI models locally on your device
• Download and manage various AI models
• Create custom AI personalities ("Pals")
• Process images using multimodal AI capabilities
• Store conversation history locally

3. User Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you must have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial purposes.

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not use the App to generate, store, or distribute any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Not attempt to reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
• Not use the App for any commercial purpose without our prior written consent
• Not interfere with or disrupt the integrity or performance of the App

6. AI-Generated Content

The AI models in the App generate responses based on input provided by you. You acknowledge that:

• AI-generated content may not always be accurate, complete, or appropriate
• You are solely responsible for how you use AI-generated content
• AI responses should not be relied upon for medical, legal, financial, or other professional advice
• We do not guarantee the quality, reliability, or suitability of AI-generated content for any particular purpose

7. Third-Party Models and Content

The App may allow you to download AI models from third-party sources such as Hugging Face. These models are subject to their own licenses and terms of use. We are not responsible for the content, accuracy, or functionality of third-party models. You agree to comply with any applicable third-party terms when using such models.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Nova AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The App may include open-source components that are subject to their respective licenses.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVA AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nova AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nova AI is headquartered, without regard to its conflict of law provisions.
